지난 2021년 3월 파생금융상품 ‘마진콜’ 사태로 월가를 뒤흔든 한인 투자가 빌 황(60·한국명 황성국·사진)씨가 10일 법원에서 유죄 평결을 받았다.
뉴욕 맨해튼 형사법원에서 진행된 아케고스 캐피털 매니지먼트(이하 아케고스) 설립자 황씨의 사기 등 혐의 사건 형사재판에서 배심원단(12명)은 이날 사기와 공갈 등 11개 중 10개 혐의에 대해 “죄가 있다”고 평결했다고 로이터통신과 미 일간 뉴욕타임스(NYT)가 보도했다.
황씨와 함께 기소된 패트릭 핼리건(47) 아케고스 최고재무책임자(CFO) 역시 사기와 공갈 등 3개 혐의에 대해 모두 유죄 평결을 받았다.두 사람은 2021년 3월 국제 금융계를 흔든 마진콜 사태 사건의 핵심 피고인이다.
케고스는 파생상품인 총수익스와프(TRS)와 차액거래(CFD) 계약을 통해 보유자산의 5배가 넘는 500억 달러 상당을 주식에 투자했다.
그러나 아케고스가 자금을 빌려 투자한 주식이 급락하게 되자, 증거금을 추가로 납부해야 하는 마진콜 상황이 발생했다.
투자은행 골드만삭스는 발 빠르게 담보주식을 블록딜로 내다 팔면서 손실을 최소화했지만, 다른 금융회사들을 중심으로는 손실이 확산했다. 당시 전체 손실액수는 100억 달러(약 13조6천억원)에 달하는 것으로 당국은 집계했다.
검찰은 2022년 황씨 등을 기소하면서, 이들이 금융회사를 속여 거액을 차입한 뒤 이를 자신들이 보유 중인 주식에 대한 파생상품에 투자함으로써 주가를 조작했다고 밝혔다.
검찰에 따르면 아케고스의 레버리지 비율은 한때 1000%에 달하기도 했다.
검찰은 재판 과정에서 아케고스 사업을 ‘카드로 만든 집’(house of cards·불안정한 계획)이자 거짓이라고 묘사하기도 했다.
반면 피고인들은 월가의 일반적인 차입(레버리지) 투자 기법일 뿐 “투자과정에서 어떠한 잘못도 저지르지 않았다”며 무죄를 주장해왔다.

Archegos Capital Management founder Sung Kook "Bill" Hwang was convicted of fraud and other charges by a jury in Manhattan federal court on Wednesday at a criminal trial in which prosecutors accused him of market manipulation ahead of the 2021 collapse of his $36 billion private investment firm.

The jury, which began deliberations on Tuesday, found Hwang guilty on 10 of 11 criminal counts and Patrick Halligan, his Archegos deputy and co-defendant, guilty on all three counts he faced. Hwang and Halligan sat flanked by their lawyers as the verdict was read by a soft-spoken foreperson.

U.S. District Judge Alvin Hellerstein set the sentencing for Oct. 28. Both men will remain free on bail.

The Archegos meltdown sent shock waves across Wall Street and drew regulatory scrutiny on three continents. Prosecutors have said Hwang and Halligan lied to banks in order to obtain billions of dollars that they used to artificially pump up the stock prices of multiple publicly traded companies. The trial began in May.

Damian Williams, the U.S. attorney in Manhattan, said the verdict should send a clear message that his office will hold accountable people like Hwang and Halligan "who think they can cheat the system."

Hwang, 60, had pleaded not guilty to one count of racketeering conspiracy, three counts of fraud and seven counts of market manipulation. Hwang was acquitted on a market manipulation charge related to a Chinese online video company, iQIYI.
