경찰은 5월26일 새벽 2시15분 41세 로드리 에스트라다(사진 오른쪽)씨의 사체를 이스트요크 주택에서 발견했다. 경찰은 911 신고를 받고 현장에 출동, 심각한 부상을 입은 여성을 발견하고 심폐소생술을 했으나 사망했다. 신고는 남편이 한 것으로 확인됐다.

경찰은 에스트라다씨를 죽인 범인이 전날 밤 10시30분~새벽 2시15분 사이 옆쪽 창문으로 들어온 것으로 파악하고 있다. 사인은 공개하지 않았다.

사망한 에스트라다씨는 세인트조셉 병원에서 간호사로 일하고 있었으며 8살·12살·13살 자녀를 뒀다. 사망한 여성의 지인에 따르면 엄마가 살해당할 때 아이들은 모두 잠들어 있었다.

경찰은 이달 3일 이 사건의 용의자 요스틴 무릴로(22)씨를 체포, 1급 살인혐의로 기소했다. 무릴로씨와 사망한 여성은 평소 친분이 없던 것으로 전해졌다.

경찰은 이어 지난 8일 23세 데이빗 백(David Beak·사진 왼쪽)씨를 같은 사건의 용의자로 체포, 역시 1급 살인혐의로 기소했다.

9일 이안 맥도넬 온타리오주 고등법원 판사는 판결문에서 "백씨와 무릴로가 침실에 혼자 있는 로드리 에스트라다(오른쪽)를 발견하고 함께 성폭행하기로 공모했으나 피해자가 저항하자 둔기(쇠막대기)로 머리를 8회 이상 때려 그를 살해했다"고 밝혔다.





40대 여성을 성폭행하고 잔인하게 살해한 혐의로 재판을 받고 있는 한인 데이빗 백(한국명 다윗)씨가 시신에는 성폭행 혐의가 적용되지 않는다며 무죄를 주장했다.

백씨의 변호사 그렉 레슬리는 11일 진행된 최종 변론에서 희생자 로드리 에스트라다는 당시 백씨와 함께 현장에 있었던 요스틴 무릴로에게 살해당했으며 이후 백씨가 시신에 저지른 성행위는 법률적으로 강간이 성립되지 않기 때문에 죄가 없다고 주장했다.

레슬리씨는 "병리학자들에 따르면 에스트라다의 사망시점을 특정하기는 어렵지만 둔기에 의한 폭행 직후 사망했을 것으로 추정하고 있다"며 "백씨가 시신에 성행위를 한 것은 사실이지만 그는 당시 대마초와 코카인, 필로폰 등의 마약 등을 다수 흡입했기 때문에 정상적인 상태가 아니었다"고 변호했다.

무릴로는 재판 과정에서 "절도행각이 발각돼 당시 소지하고 있던 쇠지렛대로 에스트라다를 수차례 가격하고 현장을 떠났다"고 진술했다.

백씨는 경찰에 체포된 직후에는 범행 당시 에스트라다가 사망한지 몰랐다고 진술했었다.

이는 변호사가 백씨의 성행위 당시 에스트라다가 이미 사망한 상태였다는 주장과 배치된다.

이에 대해 레슬리 변호사는 "백씨가 시신에 성행위를 한 사실을 숨기기 위해 거짓 진술을 한 것"이라고 설명했다.

토론토경찰은 2018년 5월26일 새벽 2시께 요스틴 무릴로와 함께 이스트요크 주택에 침입해 간호사 로드리 에스트라다(41)를 살해한 혐의 등으로 백씨를 체포했다.

Rhoderie Estrada went to sleep likely around 10 p.m. after folding laundry, watching Korean dramas and putting her three young daughters to bed in their two-storey East York home.

In the early hours of May 26, 2018, her husband came home to a nightmare — Estrada lying bloodied on their bed with head injuries too severe for him to perform CPR.

Now, after five days of deliberations, a jury has found Yostin Murillo and David Beak guilty of the first-degree murder and sexual assault of Estrada, a 41-year-old long-time dialysis nurse at St. Joseph’s hospital who adored — and was fiercely protective — of her children.

Estrada’s husband Gerald Aquintey, who attended much of the trial after his testimony, sat in the seat closest to the jury box awaiting the verdict with his head bowed. He wept in relief as the jury returned the guilty verdicts ending the harrowing seven-week long trial.

Murillo and Beak, both in their mid-twenties, will be automatically sentenced to life in prison with no chance of parole for 25 years, but a sentencing hearing has been set for Sept. 9 for Estrada’s family and friends to give victim impact statements.

The Crown argued the two men initially broke into her home to steal valuables but found Estrada alone in the bedroom and decided to sexually assault her.

In the course of sexually assaulting and forcibly confining Estrada, they repeatedly hit her in the head with metal bars breaking every bone in her face, the Crown told the jury during closing arguments. A murder involving either sexual assault and unlawful confinement is considered a first-degree murder.

Both men testified in their defence during the trial.

Murillo claimed he alone beat Estrada to death in an unexpected and unplanned attack, but argued he was too intoxicated on alcohol and meth to have the state of mind for murder and that he should be found guilty of manslaughter.
